BBT Community Funding ("BBT", "Company", "we", "us", or "our") provides its services through its website and related platforms (collectively, the "Services"). These Services are subject to the following Terms and Conditions ("Terms of Use"), including any policies referenced herein.

We reserve the right to update or modify these Terms at any time. Continued use of the Services means you accept any changes.

By accessing or using the Services, you confirm that you have read, understood, and agree to be legally bound by these Terms.

Eligibility

The Services are available only to individuals who:

• Are 18 years or older
• Have the legal capacity to enter into binding agreements
• Are using the platform in compliance with applicable laws in their country (including Kenya and other African jurisdictions)

By using the Services, you confirm that:

• All information you provide is accurate and complete
• You will not use the Services for illegal purposes (including fraud, money laundering, or unlawful fundraising)

The Services

BBT provides:

1. The ability for users ("Organizers") to create fundraising campaigns ("Fundraisers")
2. A platform for individuals ("Donors") to contribute funds ("Donations")
3. Tools to facilitate transfer of Donations to designated beneficiaries

BBT acts only as a platform facilitator and is not a charity.

• We do not guarantee success of any fundraiser
• We do not verify all information provided by users
• We are not responsible for how funds are used

Fees

As with most credit and debit transactions, there is (3%) of the amount of a Donor's Donation as a processing fee for each Donation ("Service Charge"). The Service Charge is collected from the Donor at the time that a Donor makes its Donation. The Service Charge is in addition to the amount of any Donation. We reserve the right to change the Service Charge from time to time. By using the Services, you acknowledge the Service Charge and agree to the assessment of each of these fees.

In addition to the Service Charge, you acknowledge that BBT may solicit and receive tip revenue from donors, being complimentary payments made in addition to a donation amount, which shall be retained by BBT as partial consideration for its administration of this program. Such complimentary payments, or "tips", shall not be required from any donor and shall not reduce the amount, or otherwise affect the receipt, of donations.

Role of BBT

• Facilitates donations and transfers
• Is not a bank, financial institution, or agent
• Does not control or guarantee user conduct

We are not liable for:

• Fundraiser success
• Misuse of funds
• Accuracy of campaign information

User Responsibilities

You agree:

• To provide truthful and accurate information
• To use funds strictly for the stated purpose
• Not to mislead donors
• To comply with all applicable laws

You are fully responsible for:

• Your fundraiser content
• Any funds received
• Any legal obligations arising from your activities

Content Rules

You must not post content that:

• Is false, misleading, or fraudulent
• Promotes illegal activities
• Is abusive, hateful, or discriminatory
• Violates intellectual property rights
• Impersonates another person or entity

BBT may:

• Remove content
• Suspend accounts
• Freeze funds
• Report violations to authorities

Donations

Donations:

• Are made voluntarily and at the donor's own risk
• Are not guaranteed to be refundable
• May not be tax-deductible

BBT does not guarantee:

• That funds will be used as intended
• That beneficiaries will receive funds without issues

Fund Disbursement

• Funds are distributed according to Organizer instructions
• If a beneficiary cannot be reached, funds may be redirected
• Remaining funds may be returned to the Organizer

Disbursement timelines depend on operational and verification processes.

Account Security

You are responsible for:

• Keeping your login details confidential
• All activity under your account

BBT is not liable for losses caused by unauthorized access due to your negligence.

Privacy

By using the Services, you consent to the collection and use of your data for:

• Platform operations
• Payment processing
• Legal compliance

Your information may be shared with:

• Payment providers
• Regulatory authorities
• Service partners

Disclaimer

The Services are provided "as is" and "as available".

BBT makes no guarantees regarding:

• Reliability
• Accuracy
• Availability

Use the platform at your own risk.

Limitation of Liability

BBT is not liable for:

• Loss of funds
• Failed campaigns
• Indirect or consequential damages

Indemnification

You agree to defend and indemnify BBT against any claims arising from:

• Your use of the Services
• Your violation of these Terms
• Your fundraiser activities

Dispute Resolution

Disputes shall be resolved through:

• Arbitration or mediation within your local jurisdiction
• In accordance with applicable laws of the country where the user resides

Governing Law

These Terms are governed by:

• The laws of Kenya or the applicable African jurisdiction of use

General Provisions

• If any part of these Terms is invalid, the rest remains enforceable
• These Terms represent the full agreement between you and BBT
• You may not transfer your rights under this agreement without consent
